Paine, of the precinct of New Era, in the county of Furnas and State of Nebraska, considering the uncertainty of this mortal life. And being of sound mind and memory. Blessed be God for the same do make and publish this my last will and testament in manner and form following that is to say. First, I direct that my funeral charges and expenses of administering my estate and all my debts be paid out of my personal property. If that be insufficient, I authorize my executor herafter named to seel so much of my real estate as may be necessary for that purpose. Second, I give and bequeath to my beloved wife Mattie A. Paine the sum of all moneys on hand in lieu of dower and of any distributive share in my estate to which she would otherwise be entitled. I also give and devise to my beloved wife the dwelling house and farm and real estate upon which I know reside, in said county of Furnas and State of Nebraska. Fourth, I give and bequeath to my beloved wife all the residue of my estate real and personal. Fifth, I appoint my beloved wife Mattie A. Paine executor of this my last will and testament. In witness whereof I have hereunto subscribed my name this twelfth day of May in the year of our Lord one thousand eight hundred and eighty four. Eleazer Paine. Paine, Deceased ) Petition for Letters Testimony Comes now your petitioner, Mattie A. Paine and respectfully represents to the court that Eleazar A. Paine, late of Furnas County, Nebraska, departed this life at his residence in said county, on the 6th day of January 1907, leaving a Last Will and Testament, in which Last Will and Testament your petitioner is names as executrix, which will she now offers for probate and that said Will relates to both real and personal property.. A copy of said will is attached and is marked "Exhibit A". Your petitioner further represents that the said Eleazar A. Paine at the time of his death was a resident of said county and that he left surving him his widow, Mattie A. Paine, but left no children and no other immediate heirs. Your petitioner therefore prays that the Court will appoint a time and place for proving said Will, and that notice in due form may be issued and given to all persons interested in said estate, requiriing them to appear and attend the probate of said Will, and such other proceedings as may be necessary and proper in the premises to admit said will to probate and for Letters Testamentary.
