Read More	FARM HOME NEAR KILGORE SCENE OF FATAL ERROR Coroner Renders Verdict of Death by Accident Due to Mistake in Identity --- Quiz Conducted Shotgun Fired Though Window When Lad Fails to Answer Question -- no Charges Filed Mistaken for a prowler, Charles Simmons, 20, son of Mrs. Maude Simmons, Kilgore-Amsterdam road in Loudon Township, was shot and killed early Sunday morning by his brother-in-law, Wayne Albaugh, 26 2 miles north of Kilgore. Young Simmons died before he could be removed to a hospital, from the effects of a wound inflicted with a shotgun fired at close range. According to information obtained by Coroner Clarence Deckman and Deputy Sheriff Fred Reed, who conducted an investigation at the scene of the fatal shooting, young Simmons went to East Canton Saturday night to call on a young lady with whom he had been keeping company. On his way home early Sunday morning his automobile stalled and after parking it along the Harlem Springs-Kilgore road, he walked to the residence of his brother-in-law. Mrs. Albaugh was awakened at about 5:45 o'clock by the sound of someone walking about the yard of their home and awakened her husband. The Albaughs had just completed butchering and thought someone was trying to steal their meat. Albaugh arose and obtained his shot-gun, inserting a shell in the breech before leaving the bedroom. As he passed by a widow on the first floor he saw the form of a man lurking in the shadows near the porch. Albaugh called "who are you?" but received no answer. Young Simmons in the yard flashed his flashlight through the window directly into Albaugh's face, and as the light blinded the latter he fired through the window. Immediately after the report Simmons cried out, "My God, Wayne, you've shot me." Albaugh recognized Simmons' voice and hurried out to him, picked him up and carried him into the house. Mrs. Albaugh by this time was up and ran to a neighbor's home and notified Dr. Carl Lincke, Carrollton, who in turn called sheriff John B. McFadden, who is ill at his home. The ambulance of C. C. Graham, Amsterdam was also called, but before Dr. Lincke could give aid to the wounded man and get him into the ambulance he died. Albaugh was brought to Carrollton by Deputy Sheriff Reed and Coroner Deckman, where he was questioned by Sheriff McFadden and County Prosecutor LaMoine Handley. No charges have been placed against him. Coroner Deckman Monday rendered a verdict of "accidental shooting due to mistaken identity."
